FMLA Rules and Tips

I usually don't post blogs but I felt compelled to write this only because I see the on-going issues with the education of our members and we as board members should do a better job of publicly educating our members on this major issue that's been going on for years. This is now Year 3 for me on the E-Board and now I feel this is now the time to start educating our members during a contract year to better prepare us for the fight for a fair and new contract that better suits our needs. Below are Tips of things that I feel will help members with any questions that I always answer when they call me. I always love to educate our members on how we do this and I feel that this will help our members to achieve greatness in their careers at the CTA. Some of these documents I've networked with the Management Team for our members. ( A Manager and I made a packet for the members for a Resource). Below is the Tips of the Rules of FMLA.
1. Intermittent FMLA is for your health issues. Like Asthma, Auto-Immune, Cancer and anything that is
related to Long Term Illness
2. Continuous FMLA is for temporary health issues. Like, Flu, Covid-19 anything that's not long term
illness.
3. If you go FMLA under the hour of your report time, report your illness to the Unforeseeable Claim Form
and it’s the Employee’s responsibility to Fax the claim to them to CTA HQ,(not CTA’s Responsibility)
If you don’t have a Fax Machine, go to CTA Terminal and ask the clerk if you can fax those documents
over to them.
4. Make sure you call for a claim number on your 2nd day of illness and report it to your Terminal
Manager and ask for a 7 day sick claim/leave (if you’re full time 5 days if you're a PTT)
5. 59 days is ideal to return to work so you don’t have to recertify again (take the written test word for
word).
6. CTA will charge you per the CAG when they get the notifications from Sedgewick that your claim
is denied, so make sure you’re on top of your paperwork because CTA will discharge you and then
you’ll get a approval letter of FMLA and you gotta file a grievance since you were discharged.
7. FMLA Self = Sick Book Entry
8. FMLA Family = Miss
9. Please Reference the AP1010 when you look at the Interview Record. If you're not sure what that is please ask the Terminal Manager for a copy of it so you're Educated on it. This is what CTA uses to Discipline you for your sick book entries.
Once again this should answer your questions on what to expect for FMLA. I'll also post links on my page so you can see what the AP1010 looks like and the definitions. Thank you
Thanks for educating us
